    PURPOSE OF APPLICATION: The subject application is requesting consideration under Section 45(2) of the Planning Act for the expansion of a Legal Non-Conforming Use (single family dwelling). The variances requested are to Section 6.3.3.2 (Yard Requirements, Minimum) in the Agricultural Zone. The variances requested are to the front and side yards. Where they by-law requires 16 metres the applicant has requested 4.87 metres to the front yard and 1.98 metres to the interior side yard. The dwelling is located 1.8 metres from the front yard and 5.16 metres from the interior side yard.

  • NOTICE OF COMPLETE APPLICATION FOR A PROPOSED ZONING BY-LAW AMENDMENT

    TAKE NOTICE a Zoning By-law Amendment application has been received affecting the property described above. Pursuant to Section 34 (10.4) of the Planning Act, R.S.O. 1990, c. P.13, the application was deemed complete on October 4, 2024. This Notice is being provided in accordance with the Planning Act (1990) and Ontario Regulation 545/06.

    Purpose and Effect: The subject application is proposing to rezone the property from Residential Zone 3 (R3) to Special Residential Zone 3 (R3-6). The requested amendment will allow for the reduction of the minimum rear yard depth (Section 9.2.6) from 7.5 metres to 5.5 metres to facilitate the construction of main floor decks above a rear walkout. 

  • NOTICE OF PUBLIC MEETING FOR A PROPOSED ZONING BY-LAW AMENDMENT

    TAKE NOTICE a statutory public meeting is scheduled to discuss a proposed Zoning By-law Amendment affecting the property described above.     TAKE NOTICE that the Council of The Municipality of North Perth passed By-law No. 87-2024 on the 7th day of October 2024, under Section 34 of the Planning Act, R.S.O. 1990, as amended (herein after called the “Act”). Council considered all written and oral submissions received on this application, the effect of which helped Council to make an informed decision.

     

    AND TAKE NOTICE that an appeal to the Ontario Land Tribunal in respect to all or part of this Zoning By-law Amendment may be made by filing a notice of appeal with the Clerk of the Municipality of North Perth either electronically via the Ontario Land Tribunal (OLT) e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service or by mail, no later than 4:30 p.m. on October 29th, 2024. The filing of an appeal after 4:30 p.m., in person or electronically, will be deemed to have been received the next business day. The appeal must set out the objection to the By-law, the reasons in support of the objection and must be accompanied by the appeal fee required by the OLT. The appeal fee can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario.     PURPOSE OF APPLICATION: The subject application is requesting relief from Section 12.2.6 of the North Perth Zoning By-law to reduce the minimum rear yard depth requirement from 10.5 m to 7.28 m and from Section 12.2.9 to reduce the minimum requirement for landscaped open space from 35% of the lot area to 31%. The requested relief is required to satisfy a condition of Consent Approval B12-24.
