    TAKE NOTICE that the Council of The Municipality of North Perth passed By-law No. 4-2025 on the 6th day of January, 2025, under Section 34 of the Planning Act, R.S.O. 1990, as amended (herein after called the “Act”).     TAKE NOTICE a statutory public meeting is taking place to discuss a proposed Amendment Zoning By-law affecting the property described above. The application was deemed complete on November 13, 2024 pursuant to Section 34 (10.4) of the Planning Act in accordance with the Planning Act, R.S.O. 1990. O. Reg. 545/06 s. 5

    Purpose and Effect:

    An application has been received to rezone the subject property from Residential Zone Four (R4) to Special Residential Zone 4 (R4-25) on the western portion containing a house and outbuildings and Special Residential Zone Four (R4-26) for a future residential block being requested to be created through Part Lot Control (PLC 4-2024). The R4-25 Zone will recognize the reduced front and exterior side yard setbacks of the existing dwelling and accessory structures. The R4-26 will permit reductions to the front, exterior and rear yard setbacks to accommodate a future residential dwelling.

     

    Public Delegations and Participation: We value your input. Any person may express their support, opposition or comments to this application.

     

    ANY PERSON may attend the public meeting and/or make written or verbal representation either in support of or in opposition to the proposed Zoning By-law Amendment.

     

    To submit comments or register for the Public Meeting, please contact the Municipal Clerk (contact details below) prior to 12:30 pm on the day of the meeting.

     

    If a person or public body would otherwise have an ability to appeal the decision of the Municipality of North Perth to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Municipality of North Perth before the by-law is passed, the person or public body is not entitled to appeal the decision.

     

    If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Municipality of North Perth before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

     

    ADDITIONAL INFORMATION relating to the proposed Zoning By-law Amendment is available upon request and will be shared virtually where possible. If required, arrangements can be made to have a package prepared and available for pick up at the Municipality of North Perth office.

  • Notice of Complete Application & Public Meeting for a Proposed Zoning By-law Amendment

    TAKE NOTICE an application for a Zoning By-law Amendment has been received affecting the property described above. Pursuant to Section 34 (10.4) of the Planning Act, R.S.O. 1990, c. P.13, the application was deemed complete on November 26, 2024. This Notice is being provided in accordance with the Planning Act (1990) and Ontario Regulation 545/06.

     

    Purpose and Effect: 

    The subject application is being proposed to satisfy a condition of approval for Consent File B34-24. The severed lot is to be rezoned from Agriculture Zone to Special Agriculture Zone (A-1) to permit a non-farm residential dwelling and associated accessory uses, buildings and structures.

     

    The retained lands will be rezoned from Agriculture Zone (A) to Special Agriculture Zone (A-62) to prohibit any new permanent residential dwellings.

    TAKE NOTICE that the Council of The Municipality of North Perth passed By-law No. 120-2024 on the 16th day of December, 2024, under Section 34 of the Planning Act, R.S.O. 1990, as amended (herein after called the “Act”). Council considered all written and oral submissions received on this application, the effect of which helped Council to make an informed decision.

    AND TAKE NOTICE that an appeal to the Ontario Land Tribunal in respect to all or part of this Zoning By-law Amendment may be made by filing a notice of appeal with the Clerk of the Municipality of North Perth either electronically via the Ontario Land Tribunal (OLT) e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service or by mail, no later than 4:30 p.m. on January 7th  2025. The filing of an appeal after 4:30 p.m., in person or electronically, will be deemed to have been received the next business day. The appeal must set out the objection to the By-law, the reasons in support of the objection and must be accompanied by the appeal fee required by the OLT. The appeal fee can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario. Additional information and forms can be found on the OLT website www.olt.gov.on.ca.

    PLEASE NOTE notwithstanding the above, subsection 34(19) of the Act identifies the eligible ‘persons’ that may appeal the decision to the Ontario Land Tribunal.

    NO PERSON OR PUBLIC BODY shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting, or written submissions to the council, or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

    AN EXPLANATION of the purpose and effect of the By-law, and a description of the lands to which the By-law applies, is attached. The complete By-law is available for inspection in the Clerk’s Office during regular office hours.

    Makem Development Inc. has submitted a Listowel Ward Official Plan Amendment to support the development of residential and institutional subdivision at north-east area of Listowel. The lands are currently designated “Serviced Settlement Area” in the County of Perth Official Plan and are not within the Listowel Official Plan. The proposed amendments would designate the lands Residential and Major Institutional and be subject to the policies of the Listowel Official Plan. The applicants have also submitted the file NP 23-02 which is an application to establish a Draft Plan of subdivision along with a Zoning Bylaw Amendment noted as file 15-2023.
